Partner Marissa Henderson’s article, “E-Discovery, Facebook Shenanigans, and Fraud: The Crowe v. Marquette Transportation Case,” Benedict’s Maritime Bulletin, Vol. 14, No. 1 (First Quarter 2016),” appeared on the front page of Benedict’s Maritime Bulletin, Vol. 14, No. 1 (First Quarter 2016). Her article examines the use of discovery of parties’ social media accounts in civil litigation. She discusses practice tips on how to obtain social media information during the discovery process. As a case study, she examines an interesting recent Jones Act case out of Louisiana in which the plaintiff’s Facebook Messenger texts and personal phone texts featured prominently in the litigation and for the defense. Her article also examines some of the ethical considerations for attorneys with respect to social media.
